Canada – Punitive penalties for the Temporary Foreign Worker Program (TFWP) offenders

Employers who break the rules of the Temporary Foreign Worker Program (TFWP) and the Canada flagInternational Mobility Program will pay the piper as stiff penalties for offenders were announced last week.

On July 6, Pierre Poilievre, minister of Employment and Social Development, said new consequences for businesses found non-compliant with the rules would come into effect on Dec. 1, 2015.

Non-compliant businesses could receive fines reaching up to $100,000 per violation to a maximum of $1 million in a one-year period in addition to being banned from the program for either one, two, five or 10 years.

Employers who commit the most serious violations may find themselves permanently banned from the program.

These consequences will encourage compliance and prevent employers from mistreating workers by better aligning consequences to the degree of misuse, Poilievre said.
